New feature in v10.0e:

As happens in most deceased estate cases, the family/heirs hands over everything they can find that might belong to the deceased. At this point the executor does not yet know:

1. If there is an amount due or payable on the item;

2. If it will become a claim in favour of the estate; or

3. If it will become a liability in the estate.

In order to be able to correspond with the relevant entity/person in order to establish the above, letters will have to be written. More »





From time to time we come across estates where it is necessary to lodge more than once account. LegalEase deals with this without any problems provided the user has followed the steps below very carefully. You may decide to mark the option relating to multiple L&D accounts at any stage of the file. It is not necessary to know upfront whether you will lodge more than one account. You may also de-select the option and revert back to just a First and Final account if it comes to light that more than one account is no longer required (or if you ticked it by mistake).
Step One:
1) Highlight the estate on the list of estate files and click on “Open”.
2) Tick the box towards the bottom of the screen next to the question “Will estate have multiple L&D accounts?”.
The result of this will be that the screens and questions behind the button marked “L&D a/c” will look different.
Step Two:
The program cannot guess which asset(s)/liability(ies)s you will be dealing with in each L&D account. It is up to you to indicate this to the program. It, therefore, stands to reason that you have to go back to the first account first and select the asset(s)/liability(ies)s you have dealt with in that account. Also specify how much cash (if any) you wish to carry forward from the first account to the next account. Lastly you have to generate the first L&D account again after you have made your selections (even if you don’t print it again) in order to ensure that the totals carried forward to the next account is correct. Every time you go back to the first account and select/de-select asset(s)/liability(ies)s you have to re-generate the account so that the program can update the totals carried forward.
Click on the button marked “L&D a/c” and make sure that the general information (applicable to all the accounts) contained in the first screen is correct.
Click on the tab marked “Accounts”. You will notice that the program has created a list box and that it has inserted account 1 on the list for you.

From time to time we come across estates where the deceased enjoyed a fiduciary right over a certain asset. This has to be deal with in the Fiduciary Account part of the L&D and is, effectively, like a mini L&D on its own. Effectively, the deceased does own the asset, but is has to be transferred to already identified heirs upon his death.

The names of the High Courts in South Africa have been changed with effect from 1 March 2009, when President Kgalema Motlanthe signed the Renaming of High Courts Act, as follows:
